Not everyone needs a will; it depends on each person’s financial and social circumstances. Another consideration is what type of assets the person has and whether or not they have minor children. If you have a minor child, a will is extremely important because you can designate legal guardians if you should predecease your children before they turn 18 years old. Wills are not that difficult to create, but they do not avoid probate, which is a lengthy and costly process with the court. Often time a living trust is preferable to a will because it avoids probate. Our office provides assistance with preparing all estate-planning documents. One can obtain a will online although that is not recommended. It is better to seek assistance from a lawyer in preparing a will.
